Is it legal to place the ® symbol after the name of my game even though I'm still in the process of getting it protected? I'm printing three boxes (one for my kickstarter campaign and I want to make sure I won't get in trouble if I do. Anybody have any experience with this step of the process?
Trademarking
Nothing in Kickstarter is set in stone. Everything is a "preview" of "what could-be". Art may not be 100%, box may not be 100%, logo may not be 100%... It's just a "fictitious" presentation. So from a KS perspective you don't need to worry.
What you do need to worry about is PRINTING boxes with a ® when the registration fails. In that case you may use the ™ instead.
But be certain before going to manufacturing which of the symbols you may use. That is if you application to "register" your trademark was accepted or not.
Regards.
No.
You need the TM symbol. (R) is for a registered trademark, for which you need a completed registration. Sounds like you're doing that, so you can change it to (R) later when/if you get approval.
I'm rusty on trademark stuff, but I thought you couldn't get the (R) until your symbol was actually used in trade. Pick up a package of some brand new food item from a major manufacturer, and it'll show a TM.
