Point of fact, 99% of NDAs are neither toothless nor unenforceable.
Just to clarify, Lee, I was using the Barron's words, when he said:
They are toothless and, in reality, pretty much unenforceable.
Whether NDAs are or are not toothless will have to wait for another day.
Also, I was speaking all along exclusively about the position of a designer in early- to mid-stage playtesting. Obviously, considerations are different when you're a company with a finished product and thousands of dollars on the line. I thought I made the distinction explicit, but apologies if I didn't.
